§1 Seller
The BimmerBase online store (bimmerbase.eu) is run by GoldWires Siarhei Kazlenia, ul. Generała Józefa Bema 89A, lok. 116, 15-370 Białystok, Poland, VAT number: PL5423495595, REGON: 540826963 (“Seller”). You can contact the Seller through the contact form or by e-mail at . The Seller is an independent parts retailer — not an authorized dealer or representative of BMW AG.
§2 Definitions
Customer — a person, company or organization placing an order. Consumer — a Customer who is an individual buying for purposes not related to their business. Business customer — a Customer buying in connection with their business. Parts — the goods offered in the store catalog.
§3 Orders and the contract
Placing an order in the store is an order request: it does not oblige the Customer to pay and does not yet form a contract. The Seller checks the availability and price of the Parts with its suppliers, usually within 2 business days, and then sends the Customer an order confirmation with a proforma invoice. The contract is concluded when the Seller sends the confirmation. If a Part is unavailable or its price or the delivery cost has changed, the Seller informs the Customer and may confirm the order without that Part or with the changed price; the Customer may then decline the order free of charge.
§4 Prices and payment
Prices in the store are shown net (excluding VAT). VAT is added to the order total according to the delivery country and to whether the Customer buys as a private person or as a business, chosen at checkout. VAT is charged according to the law: for example 0% for an intra-EU supply to a business with a valid EU VAT number delivered outside Poland, and Polish VAT for deliveries within Poland. The delivery cost is added to the price of the Parts. It is calculated individually for each order when the Seller checks it and is stated in the order confirmation, before payment; until then the order total is shown without the delivery cost.
Payment is made after the order confirmation, by bank transfer to the account on the proforma invoice or through the payment link provided, within 7 days. If the payment does not arrive in that time, the Seller may cancel the order.
§5 Delivery
The Parts are sent by courier after the payment is credited. Delivery times given in the store are estimates and are not guaranteed; they depend on the suppliers and on the carrier. Details: Shipping & payment.
§6 Returns and complaints
Every return or complaint starts with contacting the Seller through the contact form; parcels sent without the Seller’s instructions are not accepted. The rules — transport damage, wrong or defective parts, and the separate rules for business customers and consumers — are set out in Returns & complaints, which form part of these Terms.
For business customers the statutory warranty for defects (rękojmia) is excluded to the extent permitted by law (Art. 558 of the Polish Civil Code).
Business customers also accept the Business Purchase Agreement when placing an order; for them it forms part of these Terms and prevails where it differs. Orders from private customers are limited to 5,000 zł per order (delivery included).
§7 Consumers
A Consumer may withdraw from the contract within 14 days of receiving the Parts without giving a reason, by informing the Seller (for example through the contact form or by post). The Consumer bears the direct cost of returning the Parts and is liable for any loss in their value caused by handling them beyond what is needed to check them (for example fitting or using them) — the deduction can be as much as the full price of the Parts. The Seller refunds the payment within 14 days of receiving the statement and may withhold it until the Parts are returned. The Consumer’s statutory rights, including the rights when goods do not conform with the contract, are not limited by these Terms. The same applies to sole traders buying for purposes that are not professional for them.
Consumers may use out-of-court complaint and redress procedures, for example the regional Trade Inspection (Inspekcja Handlowa) or a consumer ombudsman (Rzecznik Konsumentów) in Poland.
§8 Final provisions
These Terms are governed by Polish law. Matters not covered here are governed by the Polish Civil Code and, for Consumers, the Polish Consumer Rights Act. Nothing in these Terms limits any right a Consumer has under mandatory law.
